What Is a Court Continuance in NC and What Does It Mean for You?

If you have ever shown up to check your court date and found it has changed, there is a good chance your case was continued. Continuances are one of the most common reasons NC court dates shift, and understanding what they are can save you from a lot of confusion and stress.
What Is a Continuance?
A continuance is a formal postponement of a scheduled court hearing to a later date. It is not a dismissal. Your case is still active and you are still required to appear. The hearing has simply been moved to a new date on the court’s calendar.
What Causes a Continuance?
Continuances happen for a wide range of reasons, and most of them have nothing to do with anything you did or did not do. Common causes include:
- Your attorney or the prosecutor needs more time to prepare
- A key witness is unavailable on the scheduled date
- The court’s docket is overloaded and your case gets pushed to make room
- New evidence or filings require additional time to review
- A scheduling conflict with the judge or a required party
In busy counties like Wake, Mecklenburg, and Johnston, docket overcrowding is one of the most frequent causes. Courts simply have more cases than available hearing slots, and cases get moved to the next available session.
Do You Have to Do Anything When Your Case Is Continued?
You do not need to file anything or take any action when your case is continued. You simply need to appear on the new date. The critical thing is making sure you actually know what the new date is.
This is where people run into trouble. If you were not in court when the continuance was granted, you may not receive direct notification of the new date. The responsibility is on you to check. If you miss the new date because you were not aware of it, the court will not treat it as an excused absence. A Failure to Appear charge can still be issued.
How to Know if Your NC Court Date Has Changed
The most reliable way to check is through the NC eCourts Portal at nccourts.gov/court-dates. Search your name using the Smart Search function in Last, First format (for example: Doe, John) to pull up your current hearing date.
